Agreement to Terms
These Terms of Service constitute a legally binding agreement between you and Hillcrest Maitland Tree Service ("Company," "we," "us," or "our") concerning your access to and use of our website and services. By accessing our website or engaging our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our website or use our services.
Services
Hillcrest Maitland Tree Service provides professional tree care services including but not limited to tree removal, tree trimming and pruning, stump grinding and removal, emergency tree services, land and lot clearing, tree health and maintenance, arborist consulting, and shrub and hedge trimming. All services are provided in accordance with industry standards and applicable local, state, and federal regulations.
Service estimates are provided based on site conditions at the time of inspection. Final pricing may vary if conditions change or additional work is required. We reserve the right to refuse service or modify service plans based on safety concerns, property conditions, or other factors affecting our ability to perform work safely and effectively.
Payment Terms
Payment is due upon completion of services unless other arrangements have been made in writing. We accept cash, check, and major credit cards. For larger projects, we may require a deposit before beginning work. Any deposit paid will be applied to the final invoice.
Late payments may be subject to interest charges at the rate of 1.5% per month or the maximum rate permitted by law, whichever is less. If legal action is necessary to collect payment, you agree to pay all costs of collection including reasonable attorney fees.
Property Access and Liability
By engaging our services, you grant us permission to access your property to perform the agreed-upon work. You are responsible for ensuring that we have clear access to work areas and for identifying any underground utilities, irrigation systems, or other hidden obstacles that may affect our work.
While we take every precaution to protect your property, tree work involves inherent risks. We maintain comprehensive liability insurance and workers' compensation coverage. However, we are not responsible for damage to underground utilities, irrigation systems, or other hidden features that were not identified prior to work beginning. We are also not liable for damage caused by acts of nature, including but not limited to falling branches from trees we did not service.
Permits and Regulations
You are responsible for obtaining any necessary permits required for tree work on your property. We can provide guidance on permit requirements, but ultimate responsibility for compliance with local ordinances rests with the property owner. We reserve the right to refuse service if required permits have not been obtained.
Cancellation Policy
If you need to cancel or reschedule services, please provide at least 24 hours notice. Cancellations with less than 24 hours notice may be subject to a cancellation fee. For emergency services, different terms may apply.
Warranty and Disclaimers
We warrant that all services will be performed in a professional and workmanlike manner in accordance with industry standards. However, we cannot guarantee specific outcomes for tree health or survival, as these depend on many factors beyond our control including weather, soil conditions, disease, and pest infestations.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OUR SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Indemnification
You agree to indemnify and hold harmless Hillcrest Maitland Tree Service, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your breach of these Terms or your violation of any law or rights of a third party.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Orange County, Florida.
Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
